General Terms And Conditions

Bookings

Reservations are made by email from the web site (regberkeley@yahoo.com), and remain valid for a two weeks period or until confirmed by return of email and payment of the deposit. The person who accepts these booking conditions, and who signs the booking page certifies that he or she is authorized to agree to the booking terms and conditions on behalf of all the persons included in the booking form, including those added or substituted at a later date.  The signatory must be a member of the party occupying the property, and must be over 21 years of age.  The property may not be sub-let or shared and may be used only by those persons named explicitly in the reservation booking forms. 

Charges

Upon receipt of a reservation request, emails will be exchanged and the renter has two weeks to submit a non-refundable deposit of $200.  The reservation is not firm until payment is received. Payment of the remainder of the fee must be received 4 weeks prior to the start date of the reservation, including the security deposit payment as outlined below.  Payment can be made via check or credit card using PayPal.

Minimum Rental Period

The minimum rental period is one week. Rental rates are quoted for one full week, and any additional nights may be reserved at the same nightly pro-rated charge.

Arrival And Departure

You may arrive (check in) no earlier that 4 pm on the first day of the reservation.  You should depart (checkout) no later than 11 am on the last day of the reservation.

Insurance

Insurance covering third parties on behalf of the renter for damage to property is included in the rental price. The coverage is valid so long as the renter respects the rental terms and conditions.

Security Deposit

A security deposit of $400 is required to cover damage to the property or its contents during the rental period. The deposit will be returned within 15 days from the end date of the rental, minus charges for any damages.  If any charges are made, a full description of the damage with photos will be provided.

Number Of People

The maximum number of people that can be accommodated is ten (10).

Condition Of The Property

The house is checked and thoroughly cleaned after each use, and is therefore in perfect condition. If there are any areas that do not meet this standard, then the renters should report any damage, loss of condition concerns by telephone or email immediately.  The house should be left in the same condition as found, except for bed linen which is cleaned and changed as part of the cleaning charge. After the rental, if any special cleaning is necessary, this will be deducted from the Security deposit.

Linens And Towels

Bed linens, bath and pool towels are provided for our guests to use.  On departure, we ask guests to place dirty linen and towels in the utility room for the cleaning crew to wash.

Indoor And Outdoor Maintenance

If there is a need for immediate indoor or outdoor repairs or general maintenance, the owner has the right (along with contractors as needed) to enter the premises, once 24 hours notice has been provided.  Lawn and pool maintenance occur on a regular weekly schedule.

Pool Safety

Florida law requires that the pool area be protected by a pool safety barrier on all rental properties.  The pool safety barrier is provided.  By accepting these terms and conditions you accept all responsibility for the safety of you and your guests and children using the pool or spa; and further that the owners are held harmless in the case of accidents or problems while using the house.

Force Majeure

The owners are not liable for any costs associated to events outside of our control, such as airline cancellations and strikes; adverse weather conditions; natural calamities etc.  Any additional expenditure to you caused by such conditions will not be reimbursed, nor will any services lost thereby be recoverable.  The owner accepts no responsibility for and injury, loss or damage caused by any reason or for any claim made as a result of this reservation and or the subsequent vacation.  The renting party is responsible for taking out adequate insurance to cover all risks.  This waiver covers all persons listed on the reservation plus any friends or relatives or other persons visiting the property at the invitation of the renter.

Jurisdiction

For any dispute the Court of Florida is the competent jurisdiction. A reservation implies knowledge and acceptance without reserve or exception of the General Conditions here set forth. If any of the conditions of the contract were or should become invalid, or if there should occur any omission, the validity of the remaining conditions will not be subject to litigation.
